We work best together and are looking forward to working with you!-------------------IMPORTANT: Due to our financial situation, the option of elective refund is being suspended. Until further notice, we can only consider refunds in situations where we know that the art can not be completed at all. Please keep this in mind BEFORE placing an order, as we will not be held responsible.

Use of "I", "me", and "my" are hereby defined as referring to the terms-owner, artist, and potential customer Astral Crescent.Use of "we" and "us" in this article are hereby defined as referring to Astral Crescent, their Power of Attorney & Secretary, and their secondary Power of Attorney & artistic partner. All of which are potential participants in any contracts on account of my mental health which is being actively and devastatingly impacted by certain parties who cost me my healthcare, home, ability to feed myself or continue taking my medication, and future. I am facing certain death. Please order from me knowing that you are buying my art to support my medical needs and that bad attitudes and unreasonable expectations will be treated none-too-gently by my multiple legal agents. As a Freelance Artist

  • Do not use our art with any algorithm or AI generator, period. Ever.

  • Do not use our work to make NFTs. If you are found to be someone who buys, sells, owns, curates, or shares NFTs/AI Art, or supports the idea of them, we will refuse your business outright.

  • We do not do business with planet-murderers or fascists.

  • We have the right to refuse service to anyone without explanation based on self-provided information we find about them online.

  • No-one is allowed to remove my, my partners, or our joint watermark off the final version we send to you privately. We mean it.

  • All orders for my solo art will be placed through & fielded by the primary Power of Attorney for quality control.

  • All orders, communications, queries, corrections, concerns, and requests pertaining to my solo art are handled, fielded, & addressed by the primary Power of Attorney.

  • All orders, communications, queries, corrections, concerns, and requests pertaining to my collaborative art with my art partner are handled, fielded, & addressed by the secondary Power of Attorney.

  • We are allowed to individually or collectively refuse any commission if it or you makes us uncomfortable-- without explanation.

  • We expect adequate information to consider your commission. If you do not give us enough information we may decline to take your commission.

  • When placing an order, you will have the option to specify if you want my coloring style or Rei's. *2

  • If you want Rei's coloring that will incur a separate charge that she will process separately. If I opt to hire her myself, I will pay her out of my own pocket. *2

  • Any commission I take on may at any point be taken over by Rei and/or Twin Fish, either for my health or because we decided it was the best direction for the art to go in.

  • We will take payment up-front in full. We do not do anything without full payment. Certain People have ruined this for everyone. Sorry.

  • If you fail to pay us for a commission and do not give us reason to believe you will make good on your balance, expect that we will reuse the art with different characters.

  • We have the right to cancel a transaction and refund you at any point in time for any reason.

  • If we give you a full refund in the event of a personal disagreement or drama, you do not retain rights to the art and I will likely reuse it with different characters.

  • If we give you a refund under civil circumstances, you are allowed to keep whatever progress we gave to you up until that point, have someone else finish it, or finish it yourself providing you abide to the terms outlined in this document.

  • For health reasons we may end the contract prematurely and give you a partial or full refund. There will be open communication about this.

  • We have full discretion over whether or not we can give you a partial or full refund and when that will be appropriate.

  • If we deliver you a product you deem incomplete, you are welcome to edit it to your desire as long as you cite me or us as the original artist(s).

  • You may edit or else have someone else edit, alter, crop, recolor, trace, etc the product we give you to your hearts content so long as you credit me or us as the original artist(s) and do not profit off of it outside of character reselling.

  • You will only be receiving a digital copy of the product unless arranged otherwise.

  • You may print the product and display it however you like, use it on social media, as graphics, or anything you like for non-commercial purposes. Providing you follow the other rules outlined in the ToS.

  • You may not use my or our art to advertise your products or sales. If you’re going to anyway, at the very least give me or us a Kofi tip or something.

  • We will never resell art you buy from us. Your characters are yours and we have no right to.

  • We will never recreate your characters intentionally nor profit off them outside our mutual agreement.

  • You may resell the product as part of a character sale (selling the ownership of it, not republishing it as prints or other products) so long as you have current rights to the subject/character.

  • Selling a character that includes art you purchased from us obligates you to share these Terms of Service with the future owner, who must then agree to abide by the rules defined. If they refuse, they do not get to own our art.

  • If they receive it anyway after refusing to agree to our terms, we will consider this Theft and may pursue legal or public action.

As a Commissioner

  • If I pay you for art of my characters and you intend to reproduce this art for profit to anyone other than me, you must make this intention clear from the start of our transaction clearly in our direct peer-to-peer communications.

  • I do NOT consent to the selling of any image or product bearing likenesses to MY characters (whether I paid you for it or not) without EXPLICIT WRITTEN PERMISSION from me & shared-profit.

  • YOU will never recreate MY characters intentionally for your personal use nor profit off them outside our mutual agreement.

  • If you display art of my characters outside of your commission promos, please credit me as their creator. I don't buy designs.

  • I will credit you every single time I host your art/characters. I expect the same.

  • I will never resell art I buy from you. Your art is yours and I have no right to.

  • I clearly define above that my customers are allowed to modify my art if it does not meet their satisfaction. I hold the same standards as a customer. *1

  • In some rare cases, If I pay for art and it does not meet either my expectations or your promises after I've asked for corrections, expect that either I will complete it or pay someone else to. *1

Bullet Clarifications

1: This is almost exclusively reserved for artists who refuse to make corrections despite being paid large amounts of money, or else artists who I ask repeatedly to make a correction and either repeatedly fail to give me what I ask for, show a lack of willingness to give me what I ask for, give me a sloppy, rushed, half-assed product, or straight up never finish my commission within a reasonable timeframe.Sometimes images must be altered to be used as references to give to other artists out of explicit interest of not continue perpetuating the endless cycle of inaccurate art, which feeds itself and becomes a constant frustration when I have to constantly tell artists that this other artists art of my character is INCORRECT and needs X and Y change. It is better for my spoons and anxiety to make X and Y change. This is also true in cases where new details were added to the character. It is not feasible to ask for retroactive changes; It's just not reasonable for any party involved. If it isn't updated, then the 200-600$ art becomes Trash and Unusable, never enjoyed or looked at again. Is that what you want for your art? As an artist I'm always updating and evolving my own art. I don't view art as static impressions in time. That's caveman ignorance and a waste of both my time and money. Sorry.** Please Note:* These are rare and extreme cases and the altered version will be kept private and never posted anywhere out of respect to the artist. But I deserve respect as a fellow artist who has high standards for my characters and expects them to be portrayed correctly and with respect.ex. If I ask you to make my character NOT SKINNY & you make them skinny, I will ask you to please fix it. If you refuse, I will be forced to edit your art in the interest of maintaining the integrity & honor of my character & friends of varied body types.-----------------------------------------------*2: I have worked off-and-on with another artist-- my best friend-- for over 15 years, and we have historically run art shops together. We have personal skill-sets that work best together. Sometimes my partner Xar helps as well.I am good at realistic proportions, exaggerated expressions, humanoid faces, fantasy creatures, cell-shading, dramatic lighting, action, background planning, and animation. I can be really good at very clean lineart if paid well to do so.Rei is good at anime-style characters, proper realism, traditional art, hands, hair, background coloring, painting, soft-shade, and stand-out dramatic painterly works. Our perspective & animals can go either way. We're both learning to draw furries at the moment. In most cases our joint process is that I will do lineart & flats, she will do shading & bg, and then I will do last-minute corrections. If she has played a role in art I have posted to twitter, I will say so on the post. Whether or not I enlist her help on any art piece is relevant to my health at the time, and whether or not I think her particular skillset is better for the overall outcome. If you order art from her, there is a chance that I will also work on that piece or play a part in its development. If you have an issue with this, you should make this clear to her up-front.This is not the default I am selling. If you do or don't want this, you must say so in my art form. Otherwise if I encounter issues, I may elect for this myself if not directed not to.

For my health, conflicts are required to go through my legal Power of Attorney.

I have disabilities that prevent me from being able to handle conflicts, confrontations, or stress. This is why I have 3 Power of Attorneys. If you initiate a confrontation on any platform, I will ignore/ block you and they will confront you.I cannot trust anyone to conduct themselves in a way that does not endanger me physically or mentally. Ignorance of this matter will not be tolerated in any form.So if anything outlined here is going to be a problem, and blocking me won't suffice, you are going to have to talk to my primary Legal & Medical Power of Attorney.

Sorry to sound rude and unapproachable, but historically people have always abused any amount of softness.
